1. Scope

These Terms and Conditions ("Terms") apply to all orders placed by consumers through the online shop www.lumeasleep.com (the "Shop") with Lumea, Tesselschadestraat 25, 8913 HA Leeuwarden, Netherlands, KvK number 94684529 ("we", "us"). A consumer is any individual who is acting for purposes that are wholly or mainly outside their trade, business, craft or profession.

2. Formation of contract

The presentation of products in the Shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the "Buy now" / "Place order" button, you submit a binding order for the goods in your basket. We confirm receipt of your order by email immediately after it is submitted. The contract of sale is concluded upon our order confirmation, or at the latest when the goods are dispatched. The contract text is stored; your order details and these Terms are sent to you by email. The contract language is English.

3. Prices and payment

All prices shown are final prices and include VAT where applicable. Any additional delivery costs are clearly displayed during checkout before you place your order. Payment is made via the payment methods offered at checkout (e.g. credit card, PayPal, Klarna, Shopify Payments). Where you select a payment method operated by a third-party provider, that provider's terms apply in addition.

Note on crossed-out prices and discounts: Crossed-out prices refer to our own previous selling price in the Shop or, where indicated, to the recommended retail price. Where we reduce prices for consumers, the reference price shown is the lowest total price applied in the 30 days before the reduction.

4. Delivery and dispatch

Delivery is made to the delivery address you provide within the United Kingdom (further delivery countries where offered at checkout). Your order is dispatched within 1–3 working days of receipt of payment. Estimated delivery times are shown on the relevant product page and at checkout. Once your order has been dispatched, you will receive a dispatch confirmation with tracking. If a product is unavailable, we will inform you without delay and refund any payments already made.

5. Retention of title

The goods remain our property until paid for in full.

6. Right to cancel

As a consumer, you have a statutory right to cancel your order within 14 days without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Details are set out in our Cancellation Policy, which is available in the Shop and is sent to you with your order confirmation. In addition to your statutory rights, we offer a voluntary 100-night sleep trial; the conditions of the trial are set out in the Shop and do not limit your statutory rights in any way.

7. Faulty goods (statutory rights)

Your statutory rights under the Consumer Rights Act 2015 apply. This means the goods must be of satisfactory quality, fit for purpose and as described. If the goods are faulty, you may — within the limits of the law — be entitled to a repair or replacement, a price reduction, rejection of the goods with a refund, and, where applicable, damages. Nothing in these Terms affects your statutory rights.

8. Liability

We accept unlimited liability for intent and gross negligence and under applicable product liability law (including the Consumer Protection Act 1987). Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. In cases of slight negligence, we are liable only for damage resulting from the breach of essential contractual obligations, and such liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

9. Health notice

Our products are comfort and wellbeing products and are not intended to diagnose, treat, cure or prevent any illness. The information on this website does not constitute medical advice. If you have persistent complaints (e.g. chronic neck or back pain), please consult a doctor. Individual results may vary.

10. Customer reviews and user-generated content

By submitting reviews, photos or videos, you grant us a non-exclusive right, unlimited in territory and time, to use this content on our website and in our marketing channels. You warrant that you hold the necessary rights to the submitted content and that it does not infringe the rights of third parties. We reserve the right not to publish, or to remove, unlawful or offensive content. You may withdraw your consent to publication at any time with effect for the future (an email to info@lumeasleep.com is sufficient).

Note on reviews: Where reviews are marked as "verified", we ensure that they originate from consumers who have actually purchased or used the products.

11. Data protection

Information on how we process your personal data can be found in our Privacy Policy.

12. Dispute resolution

We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration body. If you have a complaint, please contact us first at info@lumeasleep.com — we will always try to resolve the matter directly with you.

13. Applicable law

These Terms are governed by the law of the Netherlands, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence — for consumers in the United Kingdom, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 — remain unaffected.

14. Severability

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
